Park City Property Management After Divorce

By Mark Nelson

It is unfortunate when relationships hit a sour note and eventually end. But what happens when you are already married and you have stuff together? Dividing property in a divorce is not easy but it can be done. It is for those who are married in community of property. In case you didn t really understand your separation the first time, Park City Property Management is what you need to know.

We first look at what community of property is and what it is about. It s an agreement that both partners in marriage share whatever assets or resources they had before the marriage. They even equally share each other s expenses, debts and liabilities. Everything is then changed in a that both partners are accessible to. Keep in mind that this isn t an agreement for partners with an antenuptial agreement. A lot of people don t know that community of property comes with the convenience of spending less.

What needs to be deliberated on primarily, is the domestic household, the one you occupied as a unit. Should the property be legally possessed by both of you, no party is authorized to evict the other from the house. You will need to reach a consensus that you are both happy with. Therefore, if you are unable to tolerate each other, you are obligated to have this discussion so as to have some sort of arrangement.

If you and your spouse have children then the rules about who retains the family home change. The parent that is more responsible for the kids, should be the one who stays in the house. This is how things will be decided upon in order to maintain the lives the children are already accustomed to. So children play a major role in who gets what.

A majority of spouses have a way of solving the separation issues without any help of a lawyer or consultant. This makes the procedure more simple, quick and swift. Then are those who went from loving to hating each other to a point where they can t even be in the same room together. They often resort to a lawyer or judge that could help with the proceedings or even help in making decisions for them.

The government must distribute everything equally between both partners. However, this does not entail that everything will be distributed equally in the literal sense. More accurately, both parties will obtain specific fractions of the possessions. This is to guarantee that both partners obtain equivalent possessions in totality. Some individuals may withhold specific belongings that they obtained from the other.

You should know that it is illegal to keep assets hidden. You should also know that it isn t fair to the other party. To avoid all the splitting up of assets in future, you should look into a tight antenuptial agreement. This way what you enter within the marriage remains your own even when you split up with the partner at the time.

There is nothing harder and time-consuming than the decision making of splitting assets in a marriage that ended.
